Parent Consent Waiver

MINOR PARTICIPATION WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK & INDEMNIFICATION AGREEMENT

IMPORTANT: THIS IS A LEGALLY BINDING CONTRACT — READ CAREFULLY BEFORE SIGNING

In consideration for allowing the above-named minor (“Minor”) to enter, access, or participate in any activities at or through Animal Paradise Gym (“Facility”), I, the lawful parent or legal guardian of the Minor, hereby acknowledge, understand, and agree as follows:

1. Voluntary Participation & Complete Assumption of Risk
I understand that the Minor’s presence at or participation in activities at the Facility—whether exercising, spectating, using equipment, attending classes, consuming food/supplements, socializing, or attending any off-site event hosted by the Facility—involves inherent and unavoidable risks of injury, illness, disability, property damage, or death.

These risks include but are not limited to:

Equipment malfunction, misuse, or failure
Improper technique by the Minor or others
Collisions with equipment, participants, or objects
Slips, trips, or falls
Exposure to contagious or infectious diseases (including but not limited to COVID-19, MRSA, influenza, or other viruses/bacteria)
Adverse reactions to supplements, food, or beverages
Negligence (ordinary or gross) by the Facility, its staff, contractors, or other participants

I knowingly and voluntarily assume all such risks, whether known or unknown, foreseen or unforeseen, and accept full responsibility for the Minor’s participation.


2. Complete Release of Liability
To the fullest extent permitted by law, I, on behalf of myself, the Minor, and our heirs, executors, administrators, assigns, and representatives, irrevocably release, waive, and forever discharge Animal Paradise Gym, its owners, officers, directors, affiliates, subsidiaries, employees, contractors, agents, sponsors, and volunteers (“Released Parties”) from any and all claims, demands, causes of action, damages, or liabilities of every kind, including but not limited to those arising from:

Personal injury, illness, or death
Property loss, damage, or theft
Exposure to contagious disease
Negligence (ordinary or gross), omissions, or acts of the Released Parties
Any event occurring on the premises or during any off-site activity

This release applies regardless of cause, even if resulting from the negligence or gross negligence of the Released Parties, to the maximum extent allowed by New Jersey law.

3. Broad Indemnification
I agree to fully defend, indemnify, and hold harmless the Released Parties from any and all claims, lawsuits, damages, costs, or expenses (including attorney’s fees) brought by or on behalf of the Minor, myself, or any third party arising from or related to:

The Minor’s participation in activities at or through the Facility
My execution of this agreement
The Minor’s violation of Facility rules or applicable laws

This indemnification applies even if such claims allege negligence or gross negligence by the Released Parties.

4. No Duty to Supervise or Guarantee Safety
I understand the Facility is not responsible for constant supervision of the Minor, for ensuring proper use of equipment, or for guaranteeing safe conditions. Any staff instruction or supervision provided is purely voluntary and does not create any duty of care beyond that required by law.

5. Medical Authorization & Costs
In the event of injury or medical emergency involving the Minor, I authorize the Facility to obtain emergency medical treatment as deemed necessary. I agree to be solely responsible for all related costs and waive any claim arising from the provision or lack of such care.

6. Food, Supplement & Allergen Disclaimer
I acknowledge that products sold or provided by the Facility may contain allergens or substances with health risks. I assume full responsibility for verifying the safety and suitability of any products consumed by the Minor and release the Released Parties from all liability related to such consumption.

7. Media Consent
I grant the Released Parties the irrevocable right to record, photograph, and use the Minor’s likeness for any lawful purpose, including promotional and commercial use, in perpetuity, without further consent or compensation.

8. Rules, Conduct & Termination of Access
I agree that the Minor will comply with all Facility rules and policies. I understand that violation of such rules may result in immediate suspension or termination of access without refund, and I waive any related claim.

9. Binding Nature, Severability & Governing Law
This agreement is binding upon me, the Minor, and our heirs, assigns, and legal representatives. If any provision is held unenforceable, the remaining provisions shall remain in effect. This agreement is governed by New Jersey law, and any disputes shall be resolved exclusively in Cumberland County, NJ.

10. Acknowledgment of Understanding
I HAVE READ THIS AGREEMENT THOROUGHLY, FULLY UNDERSTAND ITS TERMS, AND SIGN IT FREELY AND VOLUNTARILY. I UNDERSTAND I AM WAIVING SUBSTANTIAL LEGAL RIGHTS—INCLUDING THE RIGHT TO SUE THE RELEASED PARTIES FOR NEGLIGENCE OR GROSS NEGLIGENCE—TO THE MAXIMUM EXTENT PERMITTED BY LAW.
